1. Your statutory right to withdraw
Under the Polish Consumer Rights Act of 30 May 2014 (transposing Directive 2011/83/EU), if you bought as a consumer or as a sole proprietor purchasing for non-business purposes, you may withdraw from the contract within 14 days from the day you (or a third party you indicated) take physical possession of the goods. You do not need to give a reason.
2. How to withdraw
Send an unambiguous statement of withdrawal before the 14-day period ends. You can:
- Email us at b2trshots@gmail.com with your order number,
- use the model withdrawal form below (download / copy and send),
- or send any letter that clearly states you are withdrawing.
We will confirm receipt of your statement immediately by email.
3. Sending the goods back
Return the goods to ul. Kaprów 19/7, 80-316 Gdańsk, Polska within 14 days of sending us your withdrawal statement. Returning the goods earlier is fine.
We provide a prepaid return label and cover the cost of returning the goods.
4. Refund
We refund all payments received from you, including the standard delivery cost (if you chose a more expensive delivery method, we refund the standard cost only), no later than 14 days from the day we receive your withdrawal statement. We may withhold the refund until we have received the goods or proof of return, whichever is earlier.
Refunds are issued via the same payment method you used, unless you have expressly agreed otherwise; in any event, you will not be charged any fees for the refund.
5. Food and sealed-goods exception
Under Art. 38(1)(5) of the Consumer Rights Act, the right of withdrawal does not apply to goods delivered in sealed packaging which, after opening, cannot be returned for hygiene or health-protection reasons. Our beetroot shots are perishable food in sealed bottles, so:
- Unopened bottles within their best-before date can be returned in full.
- Opened bottles, or bottles with a damaged seal, are not eligible for withdrawal once the seal has been broken.
- Bottles delivered damaged, defective, or past their best-before date are always covered — see the conformity rules in our Terms (§6).
6. Diminished value
You are liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.
7. Complaints (rękojmia / conformity)
Withdrawal is separate from your conformity rights. If a product is defective or does not match the description, you have two years from delivery to claim repair, replacement, a price reduction, or — if the defect is material — to withdraw. We respond to conformity complaints within 14 days of receiving them. See Terms §6 for the procedure.
8. Out-of-court dispute resolution
You may use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr to settle disputes out of court. You may also contact your local Inspekcja Handlowa office or, in Poland, the Wojewódzki Inspektor Inspekcji Handlowej for mediation. Use of these mechanisms is voluntary.
