§1. Who we are
These Terms govern sales made through the online store at back2theroots.pl (the "Store") by Kuba Lizakowski, sole proprietor trading as „shaggzclothing" (Back 2 The Roots), with registered address at Św. Ducha 63/65 mieszkanie 11, 80-834 Gdańsk, Polska, NIP 5833513631, REGON 529121228 (the "Seller", "we", "us"). Contact: b2trshots@gmail.com, +48 662 977 217.
§2. Definitions
- "Consumer" — a natural person concluding a sale not directly related to their business activity, within the meaning of Art. 22¹ of the Polish Civil Code.
- "Quasi-consumer" — a sole proprietor purchasing for purposes other than the trade for which they are professionally registered (Art. 385⁵ Civil Code), entitled to consumer-style protections.
- "Goods" — products listed in the Store, in particular 60 ml beetroot functional shots and multi-packs.
- "Order" — a declaration of will by the customer to conclude a contract of sale.
§3. Prices and offer
Prices in the Store are in Polish złoty (PLN), are final, and include all mandatory charges. Delivery costs, where applicable, are shown before order confirmation and added to the total.
For any product subject to a price reduction, we display the lowest price applied during the 30 days preceding the reduction, in line with Art. 4 of the Polish Act of 9 May 2014 on consumer information about prices of goods and services (as amended by the Omnibus Directive).
Product information, photographs, and stock indicators on the Store are an invitation to conclude a contract within the meaning of Art. 71 of the Civil Code, not a binding offer.
§4. Placing an order
You place an order by adding goods to the cart, choosing delivery and payment, providing required data, accepting these Terms and the Privacy Policy, and clicking the button labelled with words to the effect of "Order with obligation to pay" (Art. 17 Consumer Rights Act). The contract is concluded when we send an order confirmation to your email.
§5. Payment
We accept payments via Shopify Payments (credit/debit card, Apple Pay, Google Pay). Payment data is processed by Shopify Inc.; see their privacy notice for details.
§6. Delivery
We ship to Poland (17 PLN; free for orders totalling 200 PLN or more) and to Austria, Czechia, Denmark, Finland, France, Germany, Ireland, Italy, Netherlands, Norway, Portugal, Spain, Sweden, and the United Kingdom (flat rate of 69 PLN per order). Delivery costs are shown before order confirmation. Risk of loss or damage passes to you (or to the carrier you appointed, if you instructed a carrier we did not propose) on physical delivery of the goods, in line with Art. 548 §3 Civil Code.
On delivery, please check the parcel for visible damage. If damage is apparent, we recommend recording it with the carrier — this helps but does not condition your statutory rights against us.
§7. Right of withdrawal
Consumers and quasi-consumers have a 14-day right to withdraw from a distance contract without giving any reason. §8. Conformity of goods (rękojmia)
Goods sold to consumers and quasi-consumers must be in conformity with the contract. The Seller is liable for non-conformity existing at the time of delivery and disclosed within two years of delivery, in line with Chapter 5a of the Consumer Rights Act (in force from 1 January 2023).
In case of non-conformity you may demand: repair, replacement, a price reduction, or — if non-conformity is material — withdrawal from the contract, in the order set by Arts. 43d–43e of the Act. Send complaints to the Seller email above; we respond within 14 days of receipt. Failure to respond within that period is treated as acceptance of the complaint as filed.
§9. Personal data
We process personal data as the controller. Full information about purposes, legal bases, recipients, retention periods, and data-subject rights is in our Privacy Policy.
§10. Out-of-court dispute resolution
You may resolve disputes out of court via:
- the European Commission ODR platform at https://ec.europa.eu/consumers/odr,
- mediation by the Wojewódzki Inspektor Inspekcji Handlowej (https://uokik.gov.pl),
- a permanent consumer arbitration court at the local Inspekcja Handlowa,
- free legal aid from the consumer ombudsman (rzecznik konsumentów) in your county or city.
Use of these mechanisms is voluntary and does not waive your right to take a matter to a competent court.
§11. Amendments
We may amend these Terms for valid reasons (changes in law, additional services, technical or security needs). Orders placed before an amendment are governed by the version in force at the time of order placement. The current version, with effective date, is always available on this page.
§12. Governing law and jurisdiction
These Terms are governed by Polish law. Nothing in this clause limits any consumer protection a buyer enjoys under the law of their habitual residence within the EU. Disputes with non-consumers are subject to the courts competent for the Seller's registered seat.
